The mortgage keeps running with the land, so regardless of whether the borrower exchanges the property to another person, the mortgagee still has the privilege to offer it if the borrower neglects to pay off the loan. The borrower has the privilege to have the mortgage released from the title once the obligation is paid. By the thirteenth century in England and on the mainland the gage was restricted to a term of years and contained a relinquishment stipulation giving that if after the term the obligation was not reimbursed, title was relinquished to the loan specialist,  the term of years would grow consequently into a charge basic. So a purchaser can't accidentally purchase property subject to a mortgage, mortgages are enrolled or recorded against the title with an administration office, as an open record.
